Action Required for Incorporated Societies!

The Incorporated Societies Act 2022 replaces the previous Incorporated Societies Act 1908. You can find our discussion of the practical implications of the new legislation governing incorporated societies here.
A significant change to the law requires that societies “re-register” under the new Act. Re-registration must occur by 5 April 2026 - less than nine months away!
Societies that fail to re-register will cease to exist.
Re-registration is not necessarily a straightforward process. Each incorporated society must ensure that they have a Constitution in place which is consistent with the new Act. It is also a great opportunity to ensure that the society’s Constitution accurately records how the society operates and how you would like it to operate going forward.
Once the new Constitution is prepared, it will then need to be approved at the next Annual General Meeting (AGM) of the society.
It is therefore worth starting the process as soon as possible if you are involved with any of the thousands of societies who are yet to re-register.
